My sister has severe learning disabilities and lives in supported living. I am her “nearest relative”.
I recently discovered my sister was sectioned around 10 years ago. I was not consulted.
I managed to deduce this fact when I learned she is receiving section 117 funding because section 117 follows section 3.
I want to know the circumstances of her sectioning.
I approached the care provider, the assigned learning disabilities nurse and the GP who confirmed the sectioning informally in face to face meetings.
Afterwards I wanted more information and I wrote to ask for more details. They are quoting GPDR privacy laws and will not give me any information.
I believe the mental capacity act says that the nearest relative has to be consulted when someone is being sectioned so doesn’t that mean I have the right to know the circumstances afterwards?
